This article is for HR and general-affairs staff whose employees' children will stay behind, or whose families will split as one parent returns first. After reading it, you will be able to list what to ask families and schools about guardians and boarding. It does not say what a company must do. It focuses on questions worth asking.
First, sort out what 'the child stays' means
The same phrase covers very different situations. For example, one parent may return first while the other stays. A grandparent or relative may look after the child, or the child may enter boarding. The paperwork and the authority to check change with each. So in the first conversation with a family, ask who will live where, and with whom.
Guardian rules differ by country
IRCC in Canada (page dated 18 December 2025) says children under 17 must come with a parent or legal guardian or have a custodian in Canada, a responsible adult who is a citizen or permanent resident. The custodianship declaration (IMM 5646) is sent with the study permit application. Page 1 is notarised in Canada by the custodian and page 2 in the home country by the parents. Who counts as a minor also depends on the province's age of majority, 18 or 19.
Australia's Department of Home Affairs (checked 29 October 2026) describes two routes for students under 18. One is a CAAW, where the school approves accommodation and welfare. The other is a nominated guardian: a parent, a custodian, or a relative aged 21 or over nominated by a parent. Parental consent (Form 1229) is needed. Welfare must last until the student turns 18 or the enrolment ends plus 7 days.
The UK Home Office's Immigration Rules Appendix Child Student (updated 8 October 2026) requires the applicant to be aged 4 to 17 and to study at an independent school with a valid sponsor licence. If the child lives with a carer, the nominated guardian must be a British citizen or settled, with a signed letter of undertaking. These are summaries and do not decide whether a family qualifies. Rules change, so read the official pages directly.
Minimum standards for boarding schools
Families choosing boarding want to know how the school will look after the child. England's Department for Education national minimum standards for boarding schools (in force from 5 September 2022) are one useful reference. They contain 23 standards and cover schools in England. Boarders must be able to contact parents privately at a time that suits both, with time zones considered for international pupils. Schools need policies for illness and medication, access to local medical care and accommodation with appropriate privacy. Each boarding building needs at least one member of staff sleeping or on duty overnight. Boarders must have an independent person to raise concerns with, plus details of at least two child support services.
There are also points about guardians. If a school is involved in an educational guardian arrangement, it must check and record that it promotes the boarder's welfare, and staff may not be guardians of their own boarders. These standards do not apply as such to schools in other countries, so use them as a frame for questions.
The Council of International Schools (CIS) presents the International Taskforce on Child Protection (ITFCP) and links to 'ITFCP Expectations for School Communities'. The contents of that document and the date it was adopted could not be confirmed here. Ask the school which child-protection policy and accreditor's standards it uses, and read the details in the CIS original.
The gap when the child returns to Korea
It also helps to look ahead to the return. The Seoul Metropolitan Office of Education casebook (cases from January 2017 to November 2025) says special transfer generally rests on two or more years at a foreign school while living with parents. One case describes a mother who left during the father's posting and did not meet the special-transfer requirements. Living only with grandparents is described as making transfer difficult. Single-parent households may qualify with proof and the required periods. The casebook gives simplified examples, so suggest that families check with the education office before they decide to live apart.
How other bodies treat boarding costs
When you design or review company support, other organisations' approaches can serve as reference. The WHO eManual (read 4 November 2026) pays a US$5,300 lump sum for primary and secondary children boarding while the staff member serves at a field duty station, and not for post-secondary students. The full grant needs the child's attendance and the staff member's employment each to cover at least two-thirds of the school year. Otherwise it is reduced proportionally.
According to a 2017 article in the American Foreign Service Association's journal, the US State Department sets a higher 'away from post' rate when no adequate school exists at post. Boarding falls under that rate with a transport component, and educational travel cannot be claimed at the same time for the same child. It is 2017 material, so check the original for current rules. These are examples from other bodies, not a suggestion that your company's policy should match.
Sam's one-line tip
At the first meeting, ask the family to write on one page who the child will live with, where, and under which school rules.
Checklist
- Have you and the family sorted out the form of staying (one parent stays, a relative, boarding)?
- Have you shown the family the guardian conditions set by the official authority in the school's country?
- Have you checked whether guardian papers need notarisation both at home and locally?
- Have you compared the child's age with the local age of majority?
- For boarding, have you asked the school about parent contact, overnight staff and medical access?
- Have you suggested checking with the education office about returning to a Korean school?
- Have you confirmed in writing how company education support treats boarding and travel?
Confirm with the owner
- How does our education support policy define a boarding child, and are there attendance or employment-period conditions?
- How does child support change if one parent returns first?
- Which department handles guardian designation and paperwork support?
- Is there a place where child-protection policies received from schools are kept?
Your next step
This week, pick one family who may leave a child behind and read together the guardian conditions on the official page of the school's country (IRCC, Australian Home Affairs, UK Home Office or similar).
Always confirm your own situation with the official authority or an immigration professional.
